Make sure you name an appropriate person as executor

Naming the executor of your estate is a big decision. It is easy to just jot down the first person who comes to mind. However, the person you name has very specific duties to perform. If they can’t do those in accordance with the applicable laws, there is a chance that your loved ones will suffer the consequences.

We know that you already have a lot to think about when it comes to your estate plan. This doesn’t mean that it has to be difficult. Instead, you can take each issue individually and decide what you are going to do.

When you are trying to decide who the executor of the estate will be, you should think about someone who has common sense and who will likely outlive you. You might want to name someone older who might have more experience, but if that person passes away, you will end up in the same position, i.e., having to figure out who to name.

We can help you evaluate the options that are available so that you can get your estate plan exactly how you want it. Once you draft your estate plan, you will need to reevaluate the plan periodically to make sure that it is still accurate and reflective of your intentions.

The person whom you name as the executor and those to whom you grant powers of attorney designations should also be reviewed whenever you reevaluate your estate plan. Think about whether the person can still represent your wishes and perform the duties that are required of them. If you have doubts, it might be time to change the designation.
