As we now know, Congress did NOT change the Federal Estate Tax law which provided that anyone who died in 2010 paid no Federal Estate Taxes. Congress did, however, change what was to happen in January, 2011: instead of the exclusion amount dropping to $1,000,000, it is now $5,000,000 per person, and is "portable" between spouses. This is great news for all of our clients - and reinforces the way we have been structuring our documents - for flexibility. Keep in mind, however, that this tax law structure is in effect for only two years: CYE 2011 and 2012.

Further, New Jersey residents must still structure their estate planning to minimize the New Jersey Estate Tax: imposed on all assets (other than those passing to as spouse) over $675,000 as of the date of death.
